    Con motivo de la entrada en vigor el pasado 27 de julio de 2012 de la Ley 5/2012, de 6 de julio, se incorpora a nuestro ordenamiento jurídico la Directiva 2008/52/CE, de 21 de mayo, sobre ciertos aspectos de la mediación en asuntos civiles y mercantiles. Con independencia de que la mediación se constituye como una institución clásica para la resolución extrajudicial de conflictos, esta Ley se posiciona como la primera norma de rango general que acomete la regulación de dicha figura en nuestro ordenamiento. Este trabajo estudia, desde el análisis profundo de la citada normativa y de la institución, la implementación de la mediación como método de resolución de conflictos, centrando el interés en su desarrollo en la resolución de controversias internacionales, así como los impulsos necesarios para la definitiva, por necesaria, consolidación del mismo. Abstract: On 21st May 2008, the European Parliament formally approved the Council´s common position on the European Mediation Directive and had to be implemented into the national law of member states within three years. Spain adopted the 5/2012 Act, on 27th July 2012 on civil and commercial matters, to bring particular aspects into force. Regardless of mediation is a commonly used tool on alternative dispute resolution, this new Act come into force to regulate this ADR in our legal system for civil and commercial mediation. This paper attempts to analyze, from a thorough analysis of the law and the implementation of mediation as a dispute resolution method. With special attention to this innovative way to solve international disputes and unfolding what this Act really needs to bring strengthen into this ADR system.
